Overage Provision

The sale of the property will be subject to an Overage provision providing for Overage being payable by the purchaser to the property’s former owner if planning permission is granted on the property for the construction of new houses, flats, mobile homes, caravans or commercial development within 40 years from 30th September 2010.

If an Overage payment is triggered, the amount of Overage payable would be equivalent to 45% of the difference in the Market Value of the property with the benefit of the planning permission and its Market Value without the planning permission, less the reasonable costs incurred by the owner in obtaining the planning permission.

All offers should be submitted net of any future Overage sum which may become payable.
